Phoned them this Monday to say i'm not going back as i'd had enough. Eventually agreed to work the rest of this week unless they found replacement sooner. They phoned me Tuesday evening to say they'd found someone so I don't need to go in. Was supposed to be paid today but now they're saying they won't pay me because of how I left (didn't work my weeks notice). Can they legally do this or are they ripping me off.

@escapegoat. I worked until they found a replacement and they wrre never short staffed. I told them i'd work the whole week if need be but they found someone sooner. Don't see how that makes me a massive cunt

You should get paid for any time worked. If they replaced you before the end of your notice period you and let you go, you are not in the wrong.

I think that is your issue, your meant to work your weeks notice, you agreed if they found a replacement that you would finish, therefore your contract is terminated and your weeks notice period is no longer valid. Have they paid you for the 2 days you worked or paid you nothing?

Oh in which case they can't do that, even if you didn't work your full notice period they have to pay you for the time you have worked. I'd have a look at the ACAS website and draft yourself a letter, loads of useful info on there

You are entitled to be paid for evey hour you've worked, nothing more, nothing less. Notice periods dont really mean shit.

Mate never fuck an employer about you need to man up a bit. Having said that contact these guys.. http://www.citizensadvice.org.uk/ and have a look on the ACAS website. You should probably go in and speak to your old line manager face to face to sort thins out but make sure you're well grounded in facts first. Good luck and welcome to the adult world of pure fuckery..

a weeks notice, big boy position. seriously, do you have this conversation you had with work re your notice in writing? did the person they take on fill your exact position, or is the job slightly different (even just in a slight title change or a slight change in responsibilities) - no doubt there is because your work aint stupid like you?

unless in your contract it stated you forfeit any pay from the month if you don't work your notice period (highly unlikely) they can't withhold pay for hours worked.
